4. Accuracy of information

We make reasonable efforts to ensure that information published on the Site — including product descriptions, ingredients, sizing, pricing, and shipping estimates — is accurate at the time of publication. However:

  • Typographical errors, system errors, or inadvertent misstatements may occur. Where such an error materially affects an order, we reserve the right to correct it and to cancel or revise the affected order, with full notice and refund as required by applicable law.

We are not liable for any loss arising from temporary unavailability, scheduled maintenance, or events outside our reasonable control (including network outages, third-party service failures, or force majeure).

7. Pricing & currency

All prices on the Site are displayed in Canadian dollars (CAD) unless otherwise indicated. Prices are exclusive of applicable sales tax (GST, HST, PST, QST) which is calculated and shown at checkout based on the shipping destination. Prices may change without prior notice; the price binding on a given order is the price displayed at the point of checkout confirmation, subject to section 4 above. Reference prices (“compare-at” amounts) reflect either our standard list price or a verified market-comparable price observed during a defined reference period; they are not represented as the price at which an item was sold to every prior customer at every prior point in time.

8. Marketing, content & transparency practices

8.0 Express acknowledgment

By using the Site or placing an order, you expressly acknowledge each disclosure in the subsections below; agree that the elements described are illustrative aids and not statements of real-time fact; and confirm that your purchase decision is based on the product description, your own assessment, and the legally binding terms set out in your order confirmation email — not on the visual presentation of any animated, dynamic, composite, or AI-assisted element of the Site.

8.1 Why this section exists

Modern e-commerce sites use a wide range of dynamic visual elements — live activity indicators, social-proof widgets, urgency cues, and animated impact counters — to make the shopping experience feel alive and reduce decision fatigue. These elements have become an expected part of contemporary online retail. We use several of these tools at Wermom. We also believe customers deserve to know which numbers reflect real-time data, which are statistical representations of typical behaviour, and which are illustrative of historical performance.

8.2 Live activity indicators

You may notice elements on our Site that display dynamic numbers labelled “LIVE” — for example, the count of moms reading a page, viewing a product, or with a product currently in their cart.

  • How they work. These indicators are generated by our front-end software based on aggregate, anonymised typical-traffic ranges observed across our Site over a rolling reference period. They are refreshed at fixed intervals (every 1–2 minutes) and are not pulled from a real-time tracker of individual visitors. They do not represent the precise headcount on any page in any given second and are not represented as such.

  • Why we use them. They give a useful, at-a-glance sense of how popular a page or product tends to be, in a format that loads quickly and respects every visitor’s privacy. No individual person’s presence is being broadcast.

  • Calibration. The ranges are calibrated against our historical analytics and adjusted as our traffic evolves.

In short: live counters on Wermom are dynamic visual representations of typical activity levels — an honest indicator of popularity, not a real-time headcount.

8.3 In-kind giving programme & impact tracker

The Impact page features animated counters showing diapers, care packages, distribution points, and babies served. These figures represent Wermom’s 2026–2028 in-kind giving commitment: approximately one percent (1%) of company profit is allocated each quarter to producing dedicated giving-run inventory (diapers, wipes, belly wraps, manufactured to the same standard as retail product), which is then shipped, free of charge, to mothers in Vietnam, Cambodia, and the Philippines (with pilot programmes in development for Indonesia and Bangladesh) and distributed on the ground by Wermom’s own team and local representatives engaged directly by Wermom.

  • Funded by company profit, never by customer purchase. We do not solicit donations from customers, do not run round-up campaigns at checkout, and do not earmark any portion of the price you pay as a charitable contribution. The giving programme is a Wermom corporate philanthropy initiative, not a customer-facing fundraising activity.

  • Product, not cash. The programme delivers physical product to families. We do not transfer cash to charities, NGOs, or third-party intermediaries as part of this programme. Counter values reflect product volume manufactured and shipped, not dollar donations.

  • Self-administered. Wermom is the giver, the shipper, and the distributor. We do not partner with external NGOs or proxy charities for this programme. Local distribution is carried out by Wermom team members or by individuals directly engaged and supervised by Wermom. No third-party logo appears on this page because no third-party organisation is part of the programme.

  • Counter values reflect commitment scale. The figures shown represent our 2026–2028 commitment volume. Disbursement is coordinated quarterly. Variance between commitment scale and quarter-to-date disbursement is expected and may be material at any single point in the cycle.

  • Audited internally only; we do not currently retain a third-party charity-audit certification and do not claim one. References to external auditors should not be inferred unless explicitly published with the auditor’s name and engagement scope.

  • Records on request. Internal records of the programme — outbound shipping manifests, Canadian customs paperwork, photographic documentation of distribution where available, and team trip reports — are available on written request to legal@wermom.com from any verifiable counterparty. Some destination-country documentation may be informal due to local administrative practice; we do not represent or imply formal partner certification.

In short: the impact counter is a real corporate-giving programme expressed through a dynamic visual ticker. Numbers represent Wermom’s 2026–2028 commitment scale, funded by approximately 1% of company profit, executed by Wermom directly without external charity middlemen.

8.4 Social proof: cart & viewer counts

On product pages you may see indicators such as “X people viewing this” or “Y added to cart in the last hour.” These are generated using the same dynamic-range methodology described in section 8.2 and refresh every couple of minutes. They provide a sense of relative interest in a product without exposing any individual customer’s session data, and are not represented as a real-time count of identifiable visitors or carts.

8.5 Expert profiles & advisory voices

The Site features photographs, names, and quoted statements from healthcare professionals, mothers, and advocates who support our mission.

  • Where individuals are named with biographical detail and verified credentials, those individuals are real people who have consented to appear and whose statements have been confirmed.

  • Where photographs and short quotes appear as part of carousels, lifestyle imagery, or representative testimonials, some assets may be composite, paid creative, illustrative, or AI-assisted. Such imagery is intended to convey aesthetic and tone. It is not represented as the likeness of any specific identifiable individual unless that individual is named on the Site with verifiable credentials. No attribution to a specific real person is made or implied by visual appearance alone.

  • No likeness claim. You acknowledge that you will not infer the identity, endorsement, or statement of any specific real individual from imagery that is not paired with an explicit name and credential. To the maximum extent permitted by applicable law, you waive any claim arising solely from such an inference.

  • Verification on request. If you would like to verify any specific advisor or testimonial, please write to legal@wermom.com and we will be glad to clarify in writing.

8.6 Customer reviews & ratings

Star ratings and short review text displayed on product pages reflect aggregated feedback from our customer base, with synthesis and editing for clarity, length, brand voice, and translation where appropriate. Where a specific reviewer is named, that name has been provided by the reviewer or a representative pseudonym is used to preserve privacy. Total review counts may include moderated and translated submissions. We do not delete reviews solely because they are critical of a product, and we do not publish reviews submitted by individuals who have not interacted with the brand or programme being reviewed. You acknowledge that no specific review, taken in isolation, constitutes a contractual warranty by Wermom.

8.7 AI-assisted content

Portions of the copy, imagery, and visual design across the Site have been produced or refined with AI-assisted tools. We treat these tools the way other modern brands treat copywriters, designers, and stock photography — as production aids in service of clear, on-brand storytelling. AI-assisted material is reviewed by a human editor before publication and is held to the same standard of factual accuracy as anything else we publish. By using the Site, you acknowledge the use of such tools and agree that the presence of AI-assisted content does not, by itself, constitute a misrepresentation, provided the underlying product, programme, or service is delivered as described in the order confirmation.

8.8 Pricing, promotions & urgency

Discounts, “subscribe & save” pricing, low-stock indicators, and limited-time banners reflect either a real promotional period or a genuine inventory state. Reference prices (compare-at amounts) reflect either our standard list price or a verified market-comparable price during a defined reference period. We do not display fictitious original prices for the sole purpose of creating a discount illusion.

8.9 What is always real

  • The products you receive. Materials, sizing, and ingredient claims on product pages are verified by our quality team.

  • The in-kind giving programme. Wermom commits approximately 1% of company profit to producing extra units of its retail products and shipping them, free, to mothers in Vietnam, Cambodia, and the Philippines, distributed directly by Wermom’s own team. The programme is funded entirely from company profit, not from customer purchases. Internal records (shipping manifests, customs paperwork, photo documentation, trip reports) are available on written request from any verifiable counterparty.

  • Your data. The personal information you give us is handled per our Privacy Policy. We do not sell it.

  • Our policies. Returns, shipping, warranties, and guarantees are honoured exactly as written on the relevant policy pages.

8.10 Express waiver of reliance-based claims

To the maximum extent permitted by applicable law, you waive any claim against Wermom Essentials Canada Inc. that arises solely from your reliance on, or interpretation of, the illustrative or statistical elements described in sections 8.2 through 8.7, where (a) such elements are clearly disclosed as illustrative or statistical in this notice, and (b) the underlying product, programme, or service is delivered as described in the order confirmation. Nothing in this clause limits any non-excludable consumer right under applicable Canadian or provincial law, including without limitation rights conferred by the Quebec Consumer Protection Act, the Ontario Consumer Protection Act, the Competition Act (Canada), or any equivalent statute in your province or territory of residence.

9. Consumer rights

Nothing in this notice or any other policy on the Site limits or excludes statutory rights granted to you as a consumer under applicable Canadian federal or provincial consumer-protection laws, including (where applicable) the Consumer Protection Act (Ontario), the Consumer Protection Act (Quebec), and equivalents in other provinces and territories. Where any term of this notice conflicts with such statutory rights, the statutory rights prevail to the extent of the conflict.

10. Product availability & geographic scope

The Site is intended for residents of Canada. Product availability, shipping options, and applicable taxes are determined at checkout based on the destination address. We may decline orders to destinations we do not currently serve. Orders to destinations outside Canada, where accepted, may be subject to additional duties and taxes for which the customer is responsible.

Wermom products are designed for everyday maternal and infant care. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease. Statements on the Site by healthcare professionals are educational in nature and do not constitute medical advice. 13. Limitation of liability

To the maximum extent permitted by applicable law, and without limiting any non-excludable consumer rights:

  • The Site and its content are provided on an “as is” and “as available” basis;

  • Wermom Essentials Canada Inc., its directors, officers, employees, contractors, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with use of the Site or reliance on its content;

  • Without limiting the foregoing, we are not liable for indirect or consequential losses arising solely from a customer’s reliance on, or interpretation of, dynamic visual elements that are clearly disclosed as illustrative in section 8 of this notice;

  • Our aggregate liability for any direct loss arising in connection with a purchase made through the Site is limited to the amount you paid for the affected order, except where applicable law provides otherwise.

14. Indemnification

You agree to indemnify, defend, and hold harmless Wermom Essentials Canada Inc., its directors, officers, employees, contractors, and agents from and against any third-party claim, demand, loss, or expense (including reasonable legal fees) arising out of (a) your breach of this notice or any other policy on the Site; (b) your misuse of the Site or any product purchased through it; or (c) any User Content you submit to the Site. We will give you prompt notice of any such claim and reasonable cooperation in your defence.

15. Reporting issues & complaints

If you believe content on the Site is inaccurate, infringes your rights, or otherwise warrants attention, please write to legal@wermom.com with: (a) the URL of the page concerned, (b) a clear description of the issue, and (c) where applicable, evidence supporting your concern. We respond to substantive complaints within ten business days and will, where appropriate, correct or remove the content.

16. Pre-litigation notice & dispute resolution

Before initiating any legal proceeding against Wermom Essentials Canada Inc., you agree to provide us with thirty (30) days’ written notice of the claim by email to legal@wermom.com so that we can attempt to resolve it in good faith. This requirement does not apply where (a) injunctive or equitable relief is required to prevent imminent harm; (b) applicable law prohibits such a notice requirement; or (c) compliance would cause a limitation period to expire. Subject to the preceding sentence, you agree to resolve any dispute on an individual basis, not as part of a class, collective, or representative proceeding, to the extent such waiver is permitted by applicable law in your province or territory of residence.

17. Governing law & jurisdiction

This notice and any non-contractual obligations arising from it are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The courts of Ontario have non-exclusive jurisdiction over any dispute arising out of or in connection with this notice, subject to mandatory consumer-protection rules that may grant a customer the right to bring proceedings in their own province of residence (including Quebec).

18. Language

This notice is published in English. A French-language version is available on written request to legal@wermom.com for customers who require it, including residents of Quebec. In the event of any discrepancy, the version in the customer’s preferred official language will be used to interpret intent for that customer.

19. Changes to this notice

We may update this notice from time to time to reflect changes in our practices, our content, or applicable law. The “Last updated” date at the top reflects the most recent revision. Material changes will be summarised at the top of this page for at least thirty days following the change and, where appropriate, communicated through our newsletter. Continued use of the Site after a change constitutes acceptance of the revised notice.

20. Severability & entire agreement

If any provision of this notice is held to be unenforceable, that provision shall be modified only to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force. Together with our Privacy Policy, Terms of Service, Refund Policy, Shipping Policy, and Purchase Options Cancellation Policy, this notice constitutes the entire understanding between you and Wermom Essentials Canada Inc. regarding your use of the Site.
